NightX Privacy Policy

Last updated: September 23, 2026

NightX, LLC ("NightX," "we," "us") makes software that nightlife venues use to run their operations. This policy explains what personal information we collect, why we collect it, how we share it, how long we keep it, and the choices you have. It covers the NightX mobile application, the NightX web application, guest-facing pages reached by QR code, our text-message program, and our website at usenightx.com. By using the services, you agree to the collection and use of information as described here.

1. Who this policy covers

Two different groups of people are described by this policy, and the difference between them matters. Venue staff and owners hold accounts on the platform. Accounts are created by invitation from the venue that employs you, and using one means accepting our Terms of Service. If you are in this group, most of the information we hold about you is information you or your employer gave us in order to set up and operate your venue.

Guests are patrons of a venue that uses NightX. If you are in this group, you do not have a NightX account and you have not entered into any agreement with us. We may nonetheless hold a limited amount of information about you — typically a phone number, a name, and a record of your reservations — because venue staff entered it in order to book your table, or because you scanned a code at your table and provided it in order to receive an update about your request. The venue you visited collected that information from you; NightX processes it on that venue's behalf in order to provide the venue with our services, and for the limited additional purposes described in this policy. Sections 4, 7, and 8 describe the choices available to you regardless of whether you hold an account.

2. Information we collect

Information you or your venue provide. For account holders, this includes your name and email address, provided at signup or when you accept a staff invitation; a phone number, if you choose to add one to your profile or use it to sign in; the role assigned to you by your venue's owner or manager, which determines what you can see and do inside the application; and information about the venue itself, such as its business name, address, and floor plan, provided during onboarding. If your venue subscribes to a paid plan, we collect the billing contact information needed to process that subscription. We never see or store payment card numbers — card details are entered directly with our payment processor and are held by that processor, not by us.

Information about guests. Where a guest provides a phone number to venue staff in order to make a reservation, or enters one on a service-request page reached by scanning a code at a table, we collect that number in order to send messages about that reservation or request, and — only where the guest has separately opted in — occasional offers from that venue. We also collect guest names as they appear on guest lists and reservations, records of reservations and visits including no-shows, and a record of every instance in which permission to send text messages was given or withdrawn.

Information collected automatically. When you use the applications, we collect device and diagnostic information used for crash and error monitoring; error reports are configured to carry an internal account identifier only, and do not carry message contents or guest information. When you visit our website, we collect information about the pages visited and basic device information through cookies and similar technologies that keep the site working and help us understand which pages are used. We do not use advertising or cross-site tracking cookies, and we do not permit third parties to use cookies on our site to build profiles of you. Most browsers allow you to block or delete cookies through their settings, and the site remains usable if you do. We also receive whatever you choose to submit through a form on the site, such as a beta application or a text-message opt-in. We do not collect precise geolocation, biometric information, or health information, we do not acquire personal information from data brokers, and the platform is not directed to anyone under 18.

3. How we use information

We use the information described above to provide and operate the platform, including reservations, check-in, service requests, floor plans, and the analytics we make available to each venue about its own operations; to send the text messages described in Section 4; to send transactional email such as invitations, receipts, and renewal reminders; to bill and administer subscriptions; to secure the platform, prevent fraud and abuse, and diagnose and fix errors; to comply with our legal obligations, including maintaining records of text-messaging consent; and to communicate with account holders about the services. We also use information to produce the aggregated and de-identified statistics described in Section 6. We do not use your personal information for third-party advertising, and we do not track you across other companies' applications or websites.

4. Text messages

NightX sends text messages to guests on behalf of the venue they visited or booked with, from a registered number, with the venue identified in the message. Messages relating to a reservation or a service request — a confirmation, a table or minimum-spend change, or an update on a request — are sent because a phone number was provided for that booking or request. Promotional messages, including offers and invitations to leave a review, are sent only where a guest has separately opted in, either by replying JOIN to a message or by selecting an option that is not pre-selected on one of our web forms. Consent to receive promotional messages is never a condition of any purchase or service.

Every grant and every withdrawal of permission is recorded in an append-only consent record, and that record is the basis on which any message is sent. You may reply STOP at any time to stop all messages from a venue's program, HELP for assistance, or START to resume. Message frequency varies. Message and data rates may apply, and charges are billed by your mobile carrier. Text-messaging originator opt-in data and consent are not shared with, or sold to, any third party or affiliate for marketing or promotional purposes. Phone numbers and message content are disclosed only to the provider that delivers the messages, solely for the purpose of delivering them.

5. How we share information

We do not sell personal information, and we have not sold personal information in the preceding twelve months. We share personal information with third-party vendors, consultants, and other service providers who perform work on our behalf — including providers of cloud hosting and data storage, authentication, payment processing, text-message and email delivery, business-address lookup, and error monitoring — and only to the extent those providers need the information in order to perform that work. Their use of the information is restricted by contract to providing their service to us. We also share information with the venue on whose behalf it was collected: if you are a guest, the venue you visited or booked with has access to the information you provided to it.

We may disclose information where we believe disclosure is required by law or legal process, or is necessary to protect the rights, property, or safety of NightX, our customers, or others, and where we receive a legal demand for a customer's information we will notify that customer unless we are prohibited from doing so. We may also disclose or transfer information in connection with a merger, acquisition, financing, reorganization, or sale of assets, or in the event of insolvency; this policy will continue to apply to information transferred in such a transaction, and we will provide notice before personal information becomes subject to a different policy.

6. Aggregated and de-identified information

We may create, use, and commercialize aggregated and de-identified information derived from use of the services — for example, statistics about nightlife trends, foot-traffic patterns, or spending patterns across many venues. Information in this form does not identify, and cannot reasonably be used to re-identify, any individual person or any venue. We maintain such information in de-identified form, we do not attempt to re-identify it, and we contractually require recipients not to attempt to re-identify it. Individual-level personal information — your name, your phone number, your visit history — is never a part of these products.

7. How long we keep information

We retain personal information for as long as necessary to provide the services, to comply with our legal obligations, to resolve disputes, and to enforce our agreements, and the period varies depending on the type of information and the purpose for which it is held. One retention period is worth stating plainly, because it is the one most likely to matter to a guest. Guest contact information — the phone number and name a venue holds for a patron — is retained for as long as that venue uses NightX, so the venue can recognize a returning guest and keep their visit history, and a guest may have it deleted at any time by the request described in Section 8.

Where a guest's contact information is deleted, the underlying reservation and visit records may be retained by the venue as operational records with the personal identifiers removed. Records of text-messaging consent and its withdrawal are retained for as long as we may need to demonstrate that consent or its withdrawal, including after other information about the same person has been deleted, because those records are the legal basis for messages already sent. Billing records are retained as required by tax and accounting law. Aggregated statistics, which identify no one, are retained indefinitely. Backups and error logs are retained on rolling short-term windows and are then overwritten.

8. Your choices

If you hold an account, you may review and update your profile information within the application at any time. You may also delete your account from within the application, under Profile. Deletion is permanent: your ability to sign in is disabled immediately, and your personal information is then purged. If you are the owner of an account, you will need to transfer ownership before deleting, which you can arrange by contacting support@usenightx.com.

If you are a guest, you may reply STOP to any message at any time to stop receiving messages. You may also request access to, correction of, or deletion of the information we hold about you by writing to support@usenightx.com from or with reference to the phone number the venue used. We will take reasonable steps to verify that you control that number before acting on the request, and we will then honor it. No account is required. Where we delete information at your request, we retain the minimal record necessary to demonstrate that we honored the request.

We will not discriminate against you for exercising any privacy right, and where we are unable to honor a request in full — for example, where a record of consent must be retained for legal reasons — we will tell you why. Our website does not respond to browser "Do Not Track" signals, as no common standard for those signals exists.

9. Notice to California residents

California's Online Privacy Protection Act applies to our website, and this policy is written to satisfy it: the categories of information we collect and the categories of third parties with whom we share it are described in Sections 2 and 5, the process for reviewing and requesting changes to your information is described in Section 8, our practice for announcing changes to this policy is described in Section 12, and our position on Do Not Track signals is stated in Section 8.

The California Consumer Privacy Act imposes obligations on businesses that meet certain size and revenue thresholds, which NightX does not currently meet. We nonetheless honor the substance of access and deletion requests from any United States resident as described in Section 8, and we do not sell or share personal information as those terms are defined in that Act. Should our business come within the scope of that Act, or should we introduce products based on the aggregated information described in Section 6, we will update this policy, including any required disclosures and opt-out mechanisms, before any such activity begins.

10. Security

We restrict access to production information on a role-based basis, encrypt information in transit, and rely on our authentication provider to handle passwords, which we never store in readable form. Payment card details are handled entirely by our payment processor and do not pass through our systems. Error reports are configured to exclude personal details. No method of transmission or storage is completely secure, and we cannot guarantee absolute security; where a security incident affects your personal information, we will notify affected individuals and the appropriate authorities as required by law.

11. Children

The platform is a workplace tool intended for adults and is not directed to children. We do not knowingly collect personal information from anyone under 18. Venues using the platform are age-restricted establishments, and guest records concern adult patrons. If we learn that we have collected personal information from a child, we will delete it.

12. Changes to this policy

We may update this policy from time to time, and when we do we will revise the date shown at the top. Where a change is material, we will notify account holders by email and by notice within the application before the change takes effect, and we will update the privacy information published with the mobile application where required. Prior versions are archived and available on request.

13. Contacting us

Questions, requests, or complaints regarding this policy may be directed to support@usenightx.com, or to NightX, LLC, 921 West Chestnut Street, Tampa, FL 33607.
